Fire Risk Reviews · David Peters DipFRA, GIFireE, MIFSM · Last updated: September 2026
1.Introduction
These Terms and Conditions apply to the desk-based fire risk assessment review service provided by Fire Risk Reviews, a trading name of David Peters operating as a sole trader. In these Terms, "the Consultant" means David Peters trading as Fire Risk Reviews, and "the Client" means the person or organisation instructing the Consultant.
By instructing Fire Risk Reviews to undertake a desk-based fire risk assessment review, the Client agrees to these Terms and Conditions.
2.Scope of Service
Fire Risk Reviews provides an independent desk-based technical review of an existing fire risk assessment for suitable commercial premises in England and Wales.
The review considers whether the existing assessment appears clear, current, internally consistent and sufficiently robust based on the information recorded within it and any supporting information supplied by the Client. It may identify significant gaps, inconsistencies, unclear findings and areas where the assessment could be improved.
The service does not involve carrying out a new fire risk assessment or inspecting the premises.
Unless specifically agreed otherwise:
- No site visit is undertaken
- No physical inspection of the premises is carried out
- No testing of fire safety systems or equipment is undertaken
- No destructive inspection is undertaken
- No certification of compliance is provided
The review is limited to the existing fire risk assessment and any supporting information supplied by the Client.
Desk-based fire risk assessment review services are provided for a wide range of commercial premises. High-risk or specialist premises outside the scope of the Consultant's registration are not accepted. Examples include hospitals, care homes, high-rise residential buildings, higher-risk sleeping accommodation and other complex premises requiring specialist assessment.
3.Client Responsibilities
The Client remains responsible for:
- Compliance with all applicable fire safety legislation
- Ensuring information supplied is accurate, complete, and up to date
- Providing all relevant documents and supporting information required for the review
- Implementing any recommendations considered appropriate
- Maintaining and reviewing their fire risk assessment as required by law
The Client acknowledges that incomplete or inaccurate information may affect the findings of the review.
4.Limitations of the Service
For a desk-based review, the Consultant relies on the documentation and information supplied by the Client and cannot verify:
- The physical condition of the premises
- The accuracy of information contained within documents supplied
- Whether fire safety arrangements described are actually present or maintained
- Hidden defects, concealed construction, or undocumented alterations
- Actual management practices within the premises
The review report represents a professional opinion based on the information available at the time the work is undertaken. No guarantee or warranty is given that the premises comply with fire safety legislation, guidance, standards, or enforcing authority expectations.
5.Fees and Payment
Fees will be agreed in writing before work commences. Unless otherwise agreed:
- Payment is due in full before work commences
- Work will not commence until payment has been received
- All fees are quoted in pounds sterling
- Fees are not subject to VAT, as the Consultant is not currently VAT registered. Should this status change, VAT will be charged at the prevailing rate
- Additional work requested outside the agreed scope may be subject to additional fees
6.Professional Judgement
The review and any associated comments or recommendations are based on professional judgement, experience, current legislation, and relevant fire safety guidance available at the time the work is undertaken. Fire safety guidance and enforcement expectations may change over time.
7.Limitation of Liability
Nothing within these Terms and Conditions limits liability for death or personal injury caused by negligence, fraud, or any liability which cannot lawfully be excluded.
Subject to the above:
- The Consultant's total liability arising from any service provided shall not exceed the fee paid for that service
- The Consultant shall not be liable for indirect, consequential, or business losses
- The Consultant shall not be liable for losses arising from incomplete, inaccurate, or misleading information supplied by others
- The Consultant shall not be liable for matters outside the agreed scope of service
The Client acknowledges that responsibility for fire safety compliance remains with the Responsible Person.
The Consultant maintains professional indemnity insurance appropriate to the nature and scale of the service provided. Details of cover are available on request.
8.Third Party Reliance
The Report is prepared solely for the Client named within the report. No third party may rely upon the Report without the prior written consent of the Consultant. The Consultant accepts no liability to any third party.
9.Confidentiality
Information supplied by the Client will be treated as confidential and will not be disclosed to third parties except:
- Where required by law
- Where necessary for professional insurance purposes
- With the Client's consent
10.Intellectual Property
Copyright in all reports and associated documents remains with the Consultant unless otherwise agreed in writing. The Client may use the Report for their own internal business purposes only. The Report must not be altered, reproduced, or distributed externally without written permission.
11.Cancellation and Refunds
The Client may cancel instructions at any time before work commences, and where work has not commenced any fees paid will be refunded in full.
By paying the fee, the Client requests that the agreed service begins immediately. Where the Client is a consumer, a statutory 14-day cancellation right applies; the Client expressly requests that work begins within that period and acknowledges that, once the agreed service has been completed and the report delivered, the service is fully performed and the right to cancel is lost. Where work has commenced but is not yet complete, the Consultant reserves the right to charge for work undertaken up to the date of cancellation.
Nothing in this section affects the Client's right to a service carried out with reasonable care and skill.
12.Complaints
Any complaint about the service should be raised in writing to the email address shown in Section 16. Complaints will be acknowledged within 5 working days and a substantive response provided within 20 working days.
13.Privacy and Data Protection
Personal information supplied by Clients is processed in accordance with the UK GDPR and the Data Protection Act 2018. Information will be used solely for the administration and delivery of services and will not be sold or shared with third parties except where required by law or for legitimate professional purposes.
Clients have the right to access, correct, or request deletion of their personal data. Reasonable steps will be taken to store information securely. By contacting Fire Risk Reviews, the Client agrees to the storage and use of information necessary to provide the requested service.
14.Website Disclaimer
The information contained on this website is provided for general information purposes only. Reliance should not be placed upon website content as a substitute for competent fire safety advice.
15.Governing Law
